User Agreement

This User Agreement (hereinafter referred to as the Agreement) is a public offer in accordance with Article 437 of the Civil Code of the Russian Federation and governs the relationship between Olga Vladimirovna Gnatovskaya, a sole proprietor (hereinafter referred to as the Seller), and any legally competent individual (hereinafter referred to as the Buyer), arising from the purchase of tickets through the pnr360.ru website.
1. General Provisions
1.1. The terms used in this Agreement have the following definitions:
Order — the Buyer’s request to the Seller to purchase services at the Observation Deck.
Electronic Order (Order) — a digital entry in the PANORAMA360 Observation Deck database confirming the reservation and payment for a visit to the PANORAMA360 Observation Deck on a specific date and time.
Seller — Olga Vladimirovna Gnatovskaya, a sole proprietor.
Buyer — a legally competent individual who has placed an Order or an Electronic Order for personal, family, household, or other needs not related to business activities.
Visitor — a person who has used (intends to use) an Order or Ticket to visit the PANORAMA360 Observation Deck.
Observation Deck — the PANORAMA360 Observation Deck, located at: Russia, Moscow, Presnenskaya Embankment, 12, Floor 89.
Observation Deck Ticket Office — the Observation Deck Ticket Office, located at: Presnenskaya Embankment, 12, Floor -2.
Hours: Monday–Thursday: 11:00 AM–9:00 PM; Friday: 11:00 AM–10:00 PM; Saturday: 10:00 AM–10:00 PM; Sunday: 11:00 AM–9:00 PM.

A ticket is a document certifying the right to visit the PANORAMA360 Observation Deck.
Website is a web resource located on the Internet at pnr360.ru.
1.2. By placing an Order or an Electronic Order, the Buyer, in accordance with Federal Law No. 152-FZ of July 27, 2006, “On Personal Data,” consents to the processing by the Seller (including the receipt from the Buyer and/or any third parties, subject to the requirements of the current legislation of the Russian Federation) of their personal data: last name, first name, patronymic, personal telephone numbers, contact information, and any other information related to their identity, accessible or known to the Seller at any given time. The Buyer confirms that by giving such consent, they are acting of their own free will and in their own interests and in the interests of the persons for whom the Electronic Order is being paid.
1.3. When purchasing Tickets from other persons, as well as on the Internet (not from official partners of the Observation Deck), in the event of any negative consequences, the Seller does not bear any responsibility.

2. Subject of the Agreement
2.1. The Seller provides the Buyer with the opportunity to purchase a Ticket for a visit to the PANORAMA360 Observation Deck via an Electronic Order and pay for such Ticket. The Buyer, in turn, places and pays for the Order or Electronic Order in accordance with the terms of this Agreement.
2.2. In accordance with Article 436 of the Civil Code of the Russian Federation, this offer is not irrevocable. The Seller reserves the right to refuse to sell a Ticket or place an Order/Electronic Order to anyone who disagrees with the terms of this Agreement. In accordance with Article 438 of the Civil Code of the Russian Federation, payment for the Order/Electronic Order constitutes unconditional acceptance of the terms of this Agreement. By paying for the Order/Electronic Order, the Buyer simultaneously agrees to the Rules for visiting the PANORAMA360 Observation Deck.
2.3. The Seller acts on its own behalf. All obligations under this Agreement arise directly between the Seller and the Buyer.

3. Terms and conditions for placing Orders during an Individual Visit

3.1. Placing an Electronic Order:
3.1. 1. To place an Electronic Order, the Buyer completes the following steps:
• Creates an Order by selecting the quantity and categories of Tickets on the website;
• Selects the date and time of the visit
• Selects Products (if necessary), specifying their quantity;
• Checks that the displayed data matches the previously made selection;
• Provides an email address;
• Checks that the displayed amount to be paid matches the previously entered data;
• Agrees to the PANORAMA360 Observation Deck Visit Rules by clicking the appropriate button;
• Agrees to the terms of this Offer by clicking the “Pay” button;
• Clicks the “Pay” button;
• Pays for the Order by credit card;
• Confirms the successful completion (creation and payment) of the Electronic Order, as evidenced by the receipt of an email containing information about the Electronic Order, along with a unique number and barcode, to the email address specified by the Buyer in the process described above.
3.1.2. The Buyer has a limited time of 15 (fifteen) minutes to make payment. If payment is not made within the allotted time for any reason, the Electronic Order will be automatically canceled.
3.1.3. When placing an Order, the Buyer must provide the necessary, true, accurate, and complete information about themselves. The Buyer is responsible for minors on whose behalf they are placing the Order.
3.1.4. The Buyer is obligated to familiarize themselves with the age restrictions for visiting the Observation Deck and ensure that they comply with the age restrictions for minor Visitors on the date for which they are placing the Order.
3.1.5. The Buyer may only place an Electronic Order for the number of Ticket categories available for sale on the website at the time of placing the Order.
3.1.6. The Buyer is notified and agrees that in the event of discrepancies between the information specified on the Ticket presented for admission to the Observation Deck and the Electronic Order generated when purchasing the Ticket, the information in the Electronic Order shall prevail.
3.1.7. The Seller reserves the right to refuse admission to the Observation Deck if the Visitor presents a Ticket with different terms and conditions for visiting the Observation Deck from the information specified in the Electronic Order (including the Ticket category), without refunding the cost of the presented Ticket.
3.1.8. Tickets may not be purchased for the purpose of subsequent sale by the Buyer or any other third party as part of their business activities.
3.2. The Buyer has the right to cancel a fully or partially paid Order or the Electronic Order through which the Ticket was purchased.
3.3. The Buyer may cancel an Order directly at the PANORAMA360 Observation Deck location: Russia, Moscow, Presnenskaya Embankment, 12, Floor 89, at the Observation Deck box office, daily in accordance with the Deck’s operating hours.
3.4. To cancel an Order, in whole or in part, the Buyer must have proof of identity and the letter containing the order number, barcode, and details received after payment. This confirmation must be provided in hard copy.
3.5. A full or partial cancellation of an Electronic Order is made upon the Buyer’s written request, using the form provided by the Seller, sent by email to welcome@pnr360.ru, indicating the Order number.
3.6. In the event of Order cancellation, the Seller reserves the right to recover from the Buyer the actual costs incurred due to the Buyer’s cancellation.
3.6.1. If an Order is cancelled no later than 10 (Ten) days prior to the Observation Deck visit date specified in the Order, the Seller’s actual costs for Observation Deck services shall be 3.5% of the cost of the cancelled Tickets.
3.6.2. If an Order is cancelled between 10 (Ten) days and 5 (Five) days prior to the Observation Deck visit date specified in the Order, the Seller’s actual costs for tickets shall be 50% (Fifty percent) of the cost of the cancelled Tickets.
3.6.3. If an Order is cancelled between 5 (Five) days and 3 (Three) days prior to the Observation Deck visit date specified in the Order, the Seller’s actual costs for tickets shall be 70% (Seventy percent) of the cost of the cancelled Tickets.
3.6.4. If an Order is cancelled later than 72 (seventy-two) hours before the date of the visit to the Observation Deck specified in the Order, the Seller’s actual expenses for the tickets shall be 100% of their cost.
3.6.5. The Seller will review the Buyer’s request to cancel the Electronic Order and the Order within 7 (seven) business days from the date of receipt of the Buyer’s corresponding application submitted in accordance with paragraphs 3.5 and 3.6 of these Rules and will notify the Buyer of the possibility/impossibility of a refund of the funds previously paid for the Order cancelled by the Buyer.
3.7. Refund for a fully or partially cancelled Electronic Order and the Order

4. Visiting the PANORAMA360 Observation Deck
4.1. To visit the PANORAMA360 Observation Deck, the Buyer/Buyers must arrive at the date and time specified in the Ticket Order. If the Visitor fails to arrive by the time specified in the Order, the Observation Deck services will be deemed properly rendered, and any money paid will not be refunded.
4.2. Visiting the PANORAMA360 Observation Deck is carried out by the Buyer/Buyers in accordance with the PANORAMA360 Observation Deck Visit Rules, approved by the Seller and published on the Website.
4.3. When receiving and paying for the Order, the Buyer must present the individual Order number or the barcode of the Electronic Order received after payment for the Order or the Electronic Order at the entrance. The Electronic Order’s unique number and barcode may be provided in paper or electronic form (i.e., on the screen of an electronic device capable of scanning the Electronic Order’s barcode; for these purposes, the device’s screen must not have a mirrored surface). Presenting photographs of the Electronic Order’s unique number or barcode at the entrance is not permitted.
4.4. Only the person who placed the Order or the person who paid for the Order, the organizer of the Buyer group, or an authorized person designated by such persons may collect the paid Order.
4.5. Visiting the Observation Deck with a single Ticket is permitted only once and only for one Visitor of the category specified on the Ticket.
4.6. The Buyer is solely responsible for the safety and protection of the unique Order number or barcode of the Electronic Order and its dissemination.
4.7. The Buyer is fully responsible for minor children and agrees that a minor child, as well as the Buyer, may be denied access to the Observation Deck through an Online Order or Order in the event of a violation of the established age restrictions or the PANORAMA360 Observation Deck Visitor Rules. The Seller reserves the right to request proof of age from the Visitor. In the absence of such proof, the Seller reserves the right to deny such person access to the Observation Deck without a refund.
4.8. Children under two (2) years of age are entitled to free access to the Observation Deck when accompanied by parents or other legal guardians holding a valid Ticket. If a child’s age cannot be determined based on their appearance, the Seller reserves the right to request proof of age. In the absence of such proof, the Seller reserves the right to deny the child free access to the Observation Deck. A maximum of two (2) children under two (2) years of age are permitted to visit the Observation Deck free of charge when accompanied by one parent or other legal guardian. If the limit for free admission to the Observation Deck specified in this paragraph is exceeded, a corresponding Child Ticket, depending on the child’s age, will be issued for the third and subsequent children.
4.9. Visiting the Observation Deck with bulky luggage, strollers, bicycles, and other items whose sum of dimensions (except in specially stipulated cases) for length, width (two diameters or axes at the base of the roll), and height exceeds 150 cm, as well as long items exceeding 220 cm in length, is prohibited. For the convenience of customers carrying luggage, strollers, bicycles, etc., a special storage locker is available on the Observation Deck premises. We recommend that customers use this storage locker to ensure a comfortable visit to the Observation Deck. The Seller is not responsible for property (money, mobile phones, documents, keys, etc.) left in coat pockets or other items deposited for safekeeping.
4.10. If the Buyer purchases a Ticket on behalf of a third party, upon transfer of the Ticket, the Buyer is obligated to inform the persons receiving the Ticket of the terms and conditions for receiving services under this User Agreement, as well as the rules for visiting the PANORAMA360 Observation Deck. If the Buyer violates this obligation, the Seller is not liable for any negative consequences resulting from the Visitor’s ignorance of the Observation Deck’s visiting conditions.
5. Other Terms

5.1. The Buyer agrees that:
5.1.1. The Seller reserves the right to suspend or terminate Ticket sales through the Website at any time without explanation and without prior notice to the Buyer. Sales may be suspended or terminated, including, but not limited to, due to the Buyer’s violation of this Agreement and/or technical circumstances, such as Website malfunctions, payment system malfunctions, communication system malfunctions, etc.;
5.1.2. The Website may contain links to other Internet resources. However, the Seller is not responsible for the availability of these resources, their content, or any consequences associated with the use of materials from such resources;
5.1.3. The Buyer may receive informational messages related to the Seller’s activities, as well as advertisements, to the mobile phone number and/or email address specified by the Buyer when placing the Online Order;
5.1.4. The Seller reserves the right to engage third parties to fulfill its obligations under this Agreement;
5.1.5. The information specified by the Buyer on the Website may be provided by the Seller upon request by authorities and persons authorized to request and receive such information in accordance with the current legislation of the Russian Federation;
5.1.6. The Service is provided “as is” and in the form in which it is available at the time of provision, without any express or implied warranties (including, but not limited to, warranties regarding the use of the Service for a specific purpose);
5.1.7. The Seller is not responsible for possible weather events or other meteorological conditions that directly or indirectly affected, or may affect, the provision of Observation Deck services, or for waiting times when ascending to and descending from the Observation Deck.
5.1.8. Images and/or likenesses of Observation Deck visitors obtained through photography and/or video recording conducted within the Observation Deck’s designated areas may be used in any way, including for commercial purposes.
5.1.9. This Agreement may be amended by the Seller unilaterally and without judicial review by posting a new Agreement on the Seller’s website pnr360.ru. The current version of the Agreement is the one posted on the Seller’s website at the time of its implementation (at the time the Buyer pays for the Electronic Order).
5.1.10. The Seller does not guarantee the ability to restore the email containing the number, barcode, and Order details confirming the Electronic Order, received by the Buyer after payment, if the Buyer loses it.

5.1.11. If a visit to the Observation Deck is impossible due to the Seller’s fault (including due to force majeure), the Seller shall provide the Buyer with the following options:
• refund the purchase price of the Electronic Order or the Order to the Buyer under the terms of Section 3 of this Agreement;
• reschedule the visit to the Observation Deck for the Electronic Order or the Order to another date and time without additional charge.
5.2. The Seller shall not be liable:
5.2.1. For the actions of banks or electronic payment systems that facilitate the transfer of funds under this Agreement;
5.2.2. For the deletion or failure to save any data, or for the failure of the Service to meet the needs or expectations of the Buyer;
5.2.3. For any damage or loss caused to the Buyer, including, but not limited to, as a result of any changes (which the Seller makes on the Website) to the procedure for providing the Service, as well as as a result of termination or suspension of the Service, deletion, failure, or failure to save any contained or transmitted data, inaccuracy and/or unreliability of the data provided by the Buyer;
5.2.4. In the event of force majeure circumstances, which include, but are not limited to, natural disasters, pandemics or epidemics, military action, national crises, strikes in an industry or region, actions or decisions of government bodies that objectively impede the fulfillment of the obligations stipulated by this Agreement, as well as failures arising in telecommunications networks, … 5.2.5. In the event of a Buyer’s violation of the Observation Deck Visit Rules.
5.3. The Seller’s liability to the Buyer is limited to the cost of the purchased Tickets.
5.4. The Seller independently determines the price of the Observation Deck and the Products. Information on the current price of the Visit and Products, as well as any changes to the price of the Visit and/or Products, is provided to Buyers at the entrance to the Observation Deck and is published by the Seller on the Observation Deck’s official website.
5.5. All disputes or disagreements arising between the Parties under or in connection with this Agreement shall be resolved through negotiation. This Agreement provides for a claims procedure for dispute resolution.
5.6. All claims shall be sent by registered mail with acknowledgment of receipt to the Seller’s address. The claim review period is ten calendar days from the date of its receipt by the Party.

5.7. In the event of failure to reach agreement by resolving the dispute through the claims procedure, all disputes arising in connection with the execution of this Agreement by the Parties shall be resolved in court in accordance with the current legislation of the Russian Federation.
